Dear Sirs/Mesdames:


Subject: Business License application – 826 Johnson Street


Your application for a retail business license at 826 Johnson Street has been
refused pursuant to section 8 of the Business License Bylaw. Section 8
provides, in part, as follows:




Before issuing any license, the License inspector may require evidence to his
reasonable satisfaction that the applicant has complied with any and all applicable
bylaws, regulations and statutes[.]


The business license application that you submitted to the City indicates a retail
use, with the declared products being books, art, and health food magazines. Considering
only the information supplied and the declarations made on the application form, there
is nothing to preclude the issuance of a retail business license to you. However, we
do reserve the right to verify the accuracy of information supplied and declarations
made on business license applications. In this case we have cause to believe that in
recent months the society has been involved in the sale and/or distribution of
controlled substances in a manner that violates federal regulations, and we further
believe that the society intends to continue the sale and/or distribution of these
products. We are not prepared to issue a retail business license for the sale or
distribution of these product unless satisfactory evidence is produced that such
distribution is in compliance with federal regulations.


It is your right to appeal this refusal to Council by submitting written notice
to the Council Clerk, Sara Beaman, at City Hall. I have enclose some documents
for your reference.
